Terms of Service

By accessing our website, submitting the Fit Check, or otherwise using our services (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind it.

The Fit Check is a free intake tool designed to help both parties evaluate a potential engagement. Completing the Fit Check does not create a service contract, guarantee an engagement, or commit BYLDA to any deliverable other than the Build Pack summary of your responses.

By submitting your information, you consent to receive communications from BYLDA by email, phone, and SMS related to your submission and project. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of SMS at any time, or email us to opt out of other channels.

You retain ownership of the information and materials you submit. You grant BYLDA a limited license to use them to evaluate your project, produce your Build Pack, and communicate with you. If you sign our mutual NDA during the Fit Check, the NDA governs confidentiality of the specific information you share on the screens that follow.

You agree not to misuse the Services, including by submitting false information, attempting to disrupt the Services, reverse-engineering them, or using them to violate any law or the rights of another.

The Services, including all software, text, graphics, and design, are owned by BYLDA or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right to our trademarks, logos, or brand.

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

To the maximum extent permitted by law, BYLDA and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred U.S. dollars ($100).

You agree to indemnify and hold BYLDA harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or your breach of these Terms.

We may suspend or terminate your access to the Services at any time for any reason, including a violation of these Terms.

These Terms are governed by the laws of the jurisdiction in which BYLDA is organized, without regard to its conflict of laws rules. Any dispute will be resolved in the courts of that jurisdiction.

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
